Case Study — Structuring an energy PPP framework
HLF International supported an African State in overhauling its legal and institutional framework applicable to public-private partnerships, with a particular focus on energy projects.
The firm’s involvement took place in a reform context aimed at strengthening the country’s attractiveness for international investors and facilitating the financing of energy infrastructure projects.
The firm conducted an in-depth analysis of the existing legislative framework, including laws and decrees relating to PPPs, as well as applicable sector-specific texts.
This analysis was carried out in light of the full PPP project cycle, from the structuring phase through to execution, identifying bottlenecks and shortcomings in the existing framework.
HLF International then formulated recommendations aimed at improving legal certainty for projects, particularly in relation to risk allocation, project governance and financing mechanisms.
The firm also participated in the drafting of legislative and regulatory texts, as well as the implementation of operational tools (standard documents, standard contracts, procedures).
Key issue: creation of an attractive and secure legal framework for the development of energy projects.
